1. About this policy
This policy explains how Felix Finance Pty Ltd (Felix, we, us, our) collects, uses, holds and discloses personal information, including credit-related information. It applies to our websites, felixfinance.com.au and try.felixfinance.com.au, and to our mortgage broking services.
We are a credit representative (number 557574) of Finsure Finance and Insurance Pty Ltd, Australian Credit Licence 384704 (Finsure). We handle personal information in line with the Privacy Act 1988 (Cth), including the Australian Privacy Principles, and, where it applies to us, Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code.
We may update this policy from time to time. The current version will always be on our website.
2. What we collect
We collect the personal information we reasonably need to help you find and apply for a loan. Depending on what you ask us to do, this may include:
contact details, such as your name, email address, phone number and address
identity information, such as your date of birth and driver licence, passport or Medicare card details
financial information, such as your income, employment, assets, liabilities, living expenses, bank statements and payslips
details of the property you want to buy or refinance, and your deposit and borrowing goals
information about your household, such as dependants and your relationship status
credit-related information (see section 8)
records of our calls, emails, meetings and messages with you
information you enter into our website forms and calculators
Sensitive information. We only collect sensitive information, such as health information, if it is relevant to your loan (for example, where a health matter affects your income or ability to repay) and you consent, or where the law allows.
Dealing with us anonymously. You can browse our website and ask general questions without telling us who you are. To arrange a loan, we need to identify you.
Information about other people. If you give us information about someone else, such as a co-borrower or guarantor, please make sure they know you are sharing it and that they can read this policy.
3. How we collect it
We collect most information directly from you, for example when you:
fill in an enquiry or assessment form on our website
book a meeting with us
speak with us by phone, video call or in person
email or message us, or send us documents
We may also collect information from others, where it is reasonable to do so or you have agreed, including:
lenders, and through Finsure's systems, about the progress and outcome of your application
credit reporting bodies, usually through a lender as part of its assessment (see section 8)
your employer, accountant, real estate agent, solicitor or conveyancer, valuers and mortgage insurers
people who refer you to us, including related bodies corporate
publicly available sources, such as property sales and title records
If we receive information we did not ask for and do not need, we will destroy or de-identify it where it is lawful and reasonable to do so.
4. Why we collect, use and disclose it
We use your personal information to:
understand your needs and assess which loans may suit you
prepare and submit loan applications on your behalf, and help you through to settlement
meet our legal obligations, including responsible lending obligations under the National Consumer Credit Protection Act 2009 (Cth) and identity verification required under anti-money laundering and counter-terrorism financing laws
respond to your enquiries and manage our relationship with you
keep in touch about your loan after settlement, for example if a better rate may be available
send you marketing, if you have not opted out (see section 6)
run, secure and improve our business and websites
handle complaints and disputes
If you do not give us the information we need, we may not be able to help you arrange a loan.
5. Who we disclose it to
We may disclose your personal information to:
lenders and other credit providers you apply to, and lenders mortgage insurers
Finsure, as our credit licensee and aggregator, and its service providers
valuers, conveyancers, solicitors and other professionals involved in your purchase or refinance
our staff and contractors, including team members based overseas (see section 7)
our service providers, such as providers of our customer database, email, booking, document handling, website and cloud storage tools
our related bodies corporate, where it is relevant to a service you have asked about or agreed to be referred to
anyone you authorise us to deal with, such as a co-borrower, accountant or family member
regulators, dispute resolution bodies, auditors and professional advisers
anyone we are required or authorised by law to disclose it to
We do not sell your personal information.
6. Marketing
We may send you information about loans, rates and services that may interest you, including by email, SMS or phone. We will not use sensitive information for marketing without your consent.
You can opt out at any time by using the unsubscribe link in our emails, replying STOP to an SMS, or contacting us (see section 13). We will action your request within a reasonable time and at no cost. We send commercial electronic messages in line with the Spam Act 2003 (Cth).
7. Overseas disclosure
Some of the tools we use to run our business, such as our customer database, email, booking and website hosting providers, store or process information outside Australia. These providers are most likely to be located in the United States, and may also use servers in other countries, including the United Kingdom and Europe. Lenders, Finsure and other third parties we deal with may also use overseas service providers under their own privacy policies.
Some members of our team work from outside Australia and may access your information to support our brokers.
We take reasonable steps to make sure our overseas team members and service providers handle personal information in a way that is consistent with the Australian Privacy Principles.
8. Credit-related information
We do not obtain credit reports automatically. With your consent, we may obtain a copy of your credit report from a credit reporting body on your behalf, or ask you to provide one, so we can understand your position and recommend suitable loans. When you apply for a loan, the lender will usually obtain its own credit report about you, and may share information from it with us so we can help with your application, as the Privacy Act allows.
The credit-related information we may hold includes:
your identification details
your current and past credit, such as loans, credit cards and repayment history
information about applications for credit you have made
default information, serious credit infringements, court judgments, insolvency information and publicly available information about your creditworthiness
information a lender gives us that is based on your credit report, such as its assessment of your application
We use this information only to help arrange credit for you and to meet our legal obligations. We do not disclose it for any other purpose unless the law allows.

Each has a policy explaining how it handles credit information. You can ask a credit reporting body not to use your credit information for pre-screening of direct marketing, and you can ask it not to use or disclose your information if you believe you have been, or are likely to be, a victim of fraud.
If you think credit-related information we hold is wrong, you can ask us to correct it (see section 11).
9. Websites, cookies and analytics
When you use our websites, we and our service providers may collect information such as your IP address, device and browser type, pages visited, how you arrived at our site and whether you completed a form. We use cookies and similar tools to make our websites work, understand how they are used, improve them, and measure and target our advertising, including on third party sites and social media. We also use third-party advertising and analytics tools, such as tracking pixels, which may collect information about your visit and use it to show you our ads on other websites and social media.
You can set your browser to refuse or delete cookies. Some parts of our websites may not work properly if you do.
Information you enter into a form on our websites is sent to our customer database so we can respond to you. Our websites may contain links to other websites. We are not responsible for how those websites handle your information.
10. Security and retention
We hold personal information in electronic systems, including cloud-based systems, and take reasonable steps to protect it from misuse, interference, loss and unauthorised access, change or disclosure.
No method of sending or storing information online is completely secure. If a data breach is likely to cause serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by law.
We keep personal information for as long as we need it for the purposes in this policy and as required by law. Credit and anti-money laundering laws generally require records to be kept for 7 years. When we no longer need it, we take reasonable steps to destroy or de-identify it.
11. Accessing and correcting your information
You can ask for access to the personal information we hold about you, or ask us to correct it if you think it is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details in section 13.
We will respond within a reasonable period. We may need to confirm your identity first. We do not charge for making a request or correcting information. We may charge a reasonable fee for providing access, and will tell you before we do. If we refuse your request, we will tell you why in writing and how to complain.
If you ask us to correct credit-related information that came from a lender or credit reporting body, we may need to consult them, and will let you know the outcome.
12. Automated decisions
We do not use computer programs to make decisions about you that could significantly affect your rights or interests. Lenders make credit decisions and may use automated systems to do so. Their privacy policies explain how.
